An Examination of Multistate Antitrust Enforcement by U.S. State Attorneys General
This article explores two U.S. Supreme Court cases purportedly relying on classical liberal theory and a negative rights/positive rights analysis to hold that individuals
absent extremely limited circumstances
do not have a right to have police come to their aid even when desperately needed. I contend that
in fact
classical liberal theory is compatible with a right to police protection
and that the Court's fundamentally flawed analysis of negative and positive rights led to its misguided opinions.
